      Ranbaxy File Suit Against Two US Drug Firms

      Ranbaxy Pharmaceuticals, the US arm of the Indian drugs manufacturer, has filed a joint complaint with Agvar Chemicals against Barr Laboratories and Teva Pharmaceuticals for breach of contract.

      The suit seeks damages and relief for the breach of contract, fraud and tortuous interference in the commercialisation of Fexofenadine hydrochloride tablets in the American healthcare market, the company said in a statement Thursday.

      Fexofenadine hydrochloride is prescribed for the relief of symptoms associated with seasonal allergic rhinitis, as also for treatment of uncomplicated skin manifestations of chronic idiopathic urticaria.

      Ranbaxy said it operated in good faith for five years to lend expertise to Barr in developing fexofenadine hydrochloride tablets and by investing in facilities to meet the demands of Barr only to be surprised by its tie-up with Teva.

      "We believe this is a breach of our agreement with Barr and accordingly are now seeking all appropriate relief from a state court in New Jersey," said Jay Deshmukh, vice president of global intellectual property for Ranbaxy.

      Florida-based Ranbaxy Pharmaceuticals is engaged in the sale and distribution of generic and branded prescription products in the US healthcare system.

      Meanwhile, Ranbaxy has decided to appeal a British High Court riling that the Indian company's Atorvastatin product infringed on one of Pfizer's European patents on Cholesterol lowering drug marketed as Lipitor.

      Ranbaxy's proposed product was found to infringe Warner Lambert and Pfizer's European patent following a hearing in the British court July 18-25.
